These Terms and Conditions (“Terms”) govern your use of the API Sonar service (“Service”) operated by API Sonar (“we,” “our,” or “us”). By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

Service Description

API Sonar is an API monitoring and uptime tracking service that provides:

Real-time monitoring of API endpoints for availability and performance
Response time tracking and latency monitoring
Status code monitoring and error detection
Customizable alert notifications for downtime and issues
Performance analytics and reporting
Secure storage of monitoring configurations and data

Account Registration and Eligibility

To use our Service, you must:

Be at least 18 years old and have the legal capacity to enter into agreements
Provide accurate, current, and complete information during registration
Maintain the security of your account credentials
Accept responsibility for all activities that occur under your account
Notify us immediately of any unauthorized use of your account

You may not create multiple accounts, share your account credentials, or use the Service for any illegal or unauthorized purpose.

Service Tiers and Usage Limits

Free Tier

Free tier users are limited to:

3 monitored endpoints maximum
15-minute monitoring frequency
Basic alert notifications
Standard support response times

Basic Tier

Basic tier users receive:

10 monitored endpoints maximum
5-minute monitoring frequency
Enhanced alert notifications
Priority support response

Pro Tier

Pro tier users receive:

20 monitored endpoints maximum
5-minute monitoring frequency
Advanced alert configurations
Premium support with dedicated assistance

Acceptable Use and Prohibited Activities

You agree not to use the Service to:

Monitor endpoints you do not own or have permission to monitor
Attempt to circumvent rate limits or service restrictions
Use the Service for any illegal, harmful, or malicious purposes
Interfere with or disrupt the Service or servers
Attempt to gain unauthorized access to our systems
Use the Service to monitor competitors' services without authorization
Violate any applicable laws, regulations, or third-party rights

We reserve the right to suspend or terminate accounts that violate these terms.

Monitoring and Data Collection

Our Service collects and processes data to provide monitoring functionality:

API endpoint URLs and monitoring configurations
Response times, status codes, and error messages
Uptime and availability metrics
Performance analytics and trend data
Account usage and subscription information

All sensitive data, including API headers, is encrypted at rest. We do not access or store the actual content of API responses beyond what is necessary for monitoring.

Billing and Subscription Terms

Subscription Plans

Subscription fees are billed in advance on a recurring basis. You authorize us to charge your payment method for all fees associated with your subscription.

Payment Processing

All payments are processed securely through Stripe. We do not store your payment information on our servers.

Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of the current billing period. No refunds are provided for partial billing periods.

Price Changes

We may modify our pricing with 30 days' notice. Price changes will not affect existing subscriptions until renewal.

Service Availability and Uptime

While we strive for high availability, we do not guarantee:

100% uptime of our monitoring service
Immediate detection of all endpoint issues
Instant delivery of all alert notifications
Uninterrupted access to the Service

We may perform scheduled maintenance with reasonable notice and will work to minimize service disruptions.

Intellectual Property Rights

The Service and its original content, features, and functionality are owned by API Sonar and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of your data and monitoring configurations. You grant us a limited license to use this data solely for providing the Service.

Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our collection and use of information as outlined in our Privacy Policy.

Limitation of Liability

To the maximum extent permitted by law, API Sonar shall not be liable for:

Indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or business opportunities
Damages resulting from service interruptions or data loss
Any damages exceeding the amount paid for the Service in the 12 months preceding the claim

This limitation applies to all causes of action, whether based in contract, tort, or other legal theories.

Disclaimers and Warranties

The Service is provided “as is” and “as available” without warranties of any kind. We disclaim all warranties, express or implied, including:

Warranties of merchantability or fitness for a particular purpose
Warranties that the Service will meet your specific requirements
Warranties that the Service will be uninterrupted or error-free
Warranties regarding the accuracy or reliability of monitoring results

Indemnification

You agree to indemnify and hold harmless API Sonar from any claims, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

Termination

We may terminate or suspend your account and access to the Service:

Immediately for violations of these Terms
With 30 days' notice for any other reason
Upon your request to close your account

Upon termination, your right to use the Service ceases immediately, and we may delete your account data in accordance with our data retention policies.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the United Kingdom. Any disputes arising from these Terms or your use of the Service will be resolved through binding arbitration in London, UK.

You agree to resolve disputes individually and waive any right to participate in a class action lawsuit.

Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through the Service with at least 30 days' notice. Continued use of the Service after changes become effective constitutes acceptance of the new Terms.
